The Subdivision Process
With CKL
The subdivision process is a lengthly and often complicated process, often involving many additional parties, to keep both you and the Councils satisfied.
Follow the 5 steps that briefly outline the stages to help you understand the subdivision process with CKL Surveying and Planning.
Step 1 - Prepare application for consent to subdivide and apply for Resource Consent
- Meet and discuss requirements
- Source and check the certificates of title
- Review and check zoning and any other interests in the land
- Review and check the District Plan
- Investigate existing services (sewer, stormwater, water etc.)
- Source and review any other survey plans
- Site inspection and measure
- Source further information if required e.g. Aerial photos
- Engage 3rd party specialists to provide reports (as required)
- Prepare and draught the subdivision application plan
- Liaise with 3rd parties regarding services
- Prepare application report and submit to Council
Step 2 - Obtain Council Resource Consent - with consent conditions
- Allow 20 working days for response from Council. Consent approval is subject to any further information requests required by Council (Section 92)
- Applicant has 15 days from date of consent to make and Objection to consent (Section 127) regarding any conditions imposed
- Summary of conditions letter prepared by CKL for client
- Client's Solicitor notified and provided copy of Resource Consent
Step 3 - Land Transfer Survey (223 Certification Stage)
- Carry out field survey, formal measuring of site, pegging of boundaries
- Computer calculations to confirm data accuracies (time consuming and comprehesive number crunching)
- Prepare and draught Cadastral Survey Dataset (Land Transfer Plans)
- Obtain from Council a Section 223 Certificate for completed plans
- Lodgement of the Section 223 completed plans to Land Information New Zealand (LINZ) - NB Certificate of Title is not issued until 224c Certification* has been lodged with LINZ
* conditions of consent - You can hold off on lodgement of 223 with LINZ until you have completed the conditions of consent and lodge together.
Step 4 - Completion of Resource Consent Conditions (224c Certification Stage)
At this stage it is up to the client to liaise with CKL regarding their progress in completing the conditions that have been imposed by Council on the Resource Consent for their Subdivision. Many of these services can be managed by the client with minimal contact with your surveyor but do keep the surveyor informed of progress to assist where necessary.- Client is responsible to complete the Resource Consent Conditions
- Services arranged for installation of 3rd Party services (phone/power/water etc..)
- Quotes/Services obtained and installed for any engineering or construction services (driveway etc..)
- Quotes/Services obtained to prepare engineering 'as built' plans
- Services arranged for installation of 3rd Party services (phone/power/water etc..)
- Arrangement for Solicitor to finalise easement documents after CKL field survey and plan draughting (if required)
- Complete any other conditions on the Resource Consent
- Ensure that the Council consent conditions have been met and inform CKL Surveyor
- Ensure that the financial contributions to Council have been paid
- Request a 224c Completion Certificate from Council
- Forward 224c Certificate to Solicitor with all relevant information
Step 5 - Lodgement of Plans with LINZ - to obtain New Certificate of Title
- Upon receipt of the 224c* Certification your Solicitor will then lodge the plan with LINZ
- LINZ grants approval, then deposits the plan
- New Certificate of Title is issued
* Ideally the Solicitor will lodge the 223 and 224c Certification together
